1. Agreement to Terms
By accessing or using the services provided by Messer Excavating ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services
Messer Excavating provides excavation, grading, land clearing, dumpster rentals, material delivery, and related construction services. All services are subject to availability and may vary based on location, weather conditions, and project requirements.
3. Estimates and Pricing
All estimates provided are based on the information available at the time of assessment. Final pricing may vary based on actual site conditions, unforeseen circumstances, or changes to project scope. We will communicate any significant changes before proceeding with additional work.
4. Payment Terms
Payment is due upon completion of services unless otherwise agreed in writing. We accept various payment methods including credit cards and checks. Late payments may be subject to additional fees. For larger projects, a deposit may be required before work begins.
5. Cancellation Policy
Cancellations must be made at least 24 hours in advance of scheduled service. Late cancellations or no-shows may result in a cancellation fee. Weather-related cancellations will be rescheduled at no additional charge.
6. Property Access and Preparation
Customers are responsible for ensuring clear access to the work area and marking any underground utilities, sprinkler systems, or other buried infrastructure. We are not liable for damage to unmarked utilities or obstructions.
7. Liability and Insurance
Messer Excavating maintains appropriate insurance coverage for our operations. However, we are not liable for pre-existing conditions, natural settling, or damage caused by factors beyond our control. Our liability is limited to the cost of services provided.
8. Permits and Regulations
Unless otherwise agreed, the customer is responsible for obtaining necessary permits and ensuring compliance with local regulations. We can assist with permit requirements upon request.
9. Disputes
Any disputes arising from our services shall first be addressed through good-faith negotiation. If unresolved, disputes will be handled through mediation or arbitration in accordance with Ohio state law.
